[Tp-legal] Text+ deliverable on the DSM Directive

Dear Peter, dear all,

87f-k is an exclusive right that allows press publishers to prevent
'information society services' to make press publications (including
individual articles in periodicals, also scientific) available online. It
looks like it may have impact on Collections, but this impact is limited by
the fact that this exclusive right is very short (only 2 years after
publication). We can write this in the report, more or less.

Regarding out-of-commerce works, this framework is potentially huge for
libraries, but the caveat here seems to be that, according to §61d UrhG
"This only applies in cases where there is no collecting society which is
exercising these rights for the relevant types of works and which is thus
representative (section 51b of the Collecting Societies Act)", so maybe all
books are excluded as rights over them are exercised by VG Wort...?
