Dear Pawel, dear Peter,
I am not fully informed about the scope of the deliverable yet. Therefore, I do not want to discourage you from including „out-of-commerce works“ in the paper.
However, I do not share your enthusiasm about „out-of-commerce works“. § 61d only applies in cases in which no representative collecting society excists as stated in § 61d para 1 s. 1. Here, VG Wort is a representative collecting society. A prerequisite for the use of „out-of-commerce works“ is the acquisition of an extended collective license for „out-of-commerce works“.
I will ask my colleagues about DNBs practice regarding the acquisition and the scope of such licenses.

From my point of view, we should pay particular attention to the "out-of-commerce works".
I can say little or nothing about §87.

Dear all,
During our meeting on Monday we discussed our deliverable on the impact of the DSM directive on Collections. I focussed our attention on the TDM exception(s), but it might have been short-sighted. In fact, there are other provisions in the DSM directive and its German transposition (https://www.bgbl.de/xaver/bgbl/start.xav?startbk=Bundesanzeiger_BGBl&start=//*%5b@attr_id=%27bgbl121s1204.pdf%27%5d#__bgbl__%2F%2F*%5B%40attr_id%3D%27bgbl121s1204.pdf%27%5D__1683709129567) that may have an impact on Collections, especially:
- new rules on the use of out-of-commerce works by cultural heritage institutions (Art. 8 of the Directive and §§61d-61g UrhG) -- this is particularly relevant for the DNB;
- the exclusive right of press publishers (Art. 15 of the Directive and §§87f-87k UrhG) with little impact on Text+, I imagine, but we may still want to include it in the report).
Do you think that we should include those as well? If so, I would welcome some thoughts from the DNB on the use of out-of-commerce works, as I have no experience with this framework. Or shall we just concentrate on TDM?
