Dear Laurence, dear all,

thank you for your feedback and considerations. Given the fact that the EUIPO has expressed their intention to develop an API for the oocw portal but fails to deliver for more than one and a half year now and communicates no clear timeline for further development it is not a general lobbying action in my opinion and a statement for which we can take responsibility as EC.

Sorry for my late response.
I have no problem with thé general words and your draft for this usefull and technocal question. But as we previously said it was not our purpose to develop a lobbying action, i guess it could sound strange for our collegues not to be asked for their position before sanding such a paper. Can the EC decide for every one ?
Anyway, I don’t want to stop the process, but I Think we have to be carefull.

please find attached a draft letter to the Executive Director of EUIPO addressing the need to develop the API for the out of commerce works portal. Please send your changes or additions to me not later than February 13th. If I do not hear from you I assume that you agree with this draft.

Dear Mr.Archambeau,

in December 2022theChair of the Out of Commerce Works Working Group Copyright Community within the Europeana Network Association wrote a letter toMr Havermansin which she expressed the severe need of the Europeana Communityfor the EUIPOtodevelop a data interface (API) for the out of commerce works portal to facilitate automated input and output workflows.

As chair of the Executive Committee of CENL, the Conference of European National Librarians, I would like toexpress my strong support for this urgent need. CENListhe network of 46 national libraries in 45 European countries.National Libraries like numerous other cultural heritage institutions preserve and curate millions of out of commerce works.

The Copyright in the Digital Single Market (CDSM) Directive has created an opportunity for their dissemination, but access to this wealth of knowledge will not be possible unless the system works well in practice. This includes the need for an efficient functioning of the EUIPO portal, one that responds to the needs, priorities and workflows of the cultural heritage institutions that provide the data. A system supported via an API can lead to a substantial increase in data being made available through the EUIPO portal, data that would otherwise not be shared because of the limitations that the current manual upload workflow will present for many cultural heritage institutions. It is therefore essential to make every step of the process an easy one if we want the system to be extensively used.

The National Libraries of Europe are looking forward to any further information and to collaborating for the success of the out of commerce works system.
