[CENL-EC] The need for active and increased development of the EUIPO out of commerce works portal, in particular through an application programming interface (API)

addressing the need to develop the API for the out of commerce works portal.

The need for active and increased development of the EUIPO out of commerce 
works portal, in particular through an application programming interface (API)

Dear Mr. Archambeau,

in December 2022 the Chair of the Out of Commerce Works Working Group 
Copyright Community within the Europeana Network Association wrote a letter to 
Mr Havermans in which she expressed the severe need of the Europeana Community 
for the EUIPO to develop a data interface (API) for the out of commerce works 
portal to facilitate automated input and output workflows.

As chair of the Executive Committee of CENL, the Conference of European 
National Librarians, I would like to express my strong support for this urgent 
need. CENL is the network of 46 national libraries in 45 European countries. 
National Libraries like numerous other cultural heritage institutions preserve 
and curate millions of out of commerce works.

The Copyright in the Digital Single Market (CDSM) Directive has created an 
opportunity for their dissemination, but access to this wealth of knowledge 
will not be possible unless the system works well in practice. This includes 
the need for an efficient functioning of the EUIPO portal, one that responds 
to the needs, priorities and workflows of the cultural heritage institutions 
that provide the data. A system supported via an API can lead to a substantial 
increase in data being made available through the EUIPO portal, data that 
would otherwise not be shared because of the limitations that the current 
manual upload workflow will present for many cultural heritage institutions. 
It is therefore essential to make every step of the process an easy one if we 
want the system to be extensively used.

The National Libraries of Europe are looking forward to any further 
information and to collaborating for the success of the out of commerce works 
system.
